The website www.aroundme.global and the Application AroundMe (hereinafter collectively referred as "App") is owned and operated by Mrdots Solutions Private Limited ("Company"), a company incorporated under the provisions of the Companies Act, 2013, with its registered office at 1-4-229, Plot No:7, Road No:7, New Maruthi Nagar (East) Kothapet, Rangareddy, Telangana, India - 500102.
The Company deals with community building, connecting people locally, and helping users make new friends through AroundMe Application.
Anyone who is accessing or using the Site/Mobile app ("User" or "They" or "You"), including individuals using a computer, mobile phone, or any other device and interacting with the contents of the App, is governed by the following Terms and Conditions (hereinafter "Terms of Use").
By merely accessing or using the App or our Services, the User, without any limitation, acknowledges that they are bound by these Terms of Use and Privacy Policy and any other policies regardless of whether they have read them or not. If the User does not wish to agree to the Terms of Use, they are free to discontinue the use of the Site.
The Company reserves the unilateral right to change the particulars contained in the Terms of Use or the Privacy Policy at any time and without notice to its users, at its sole discretion. If we have found a breach or suspected breach of the security of your account, we may require you to change your password, temporarily or permanently block or suspend your account without any liability to the Company.
The Company has the right to refuse service and/or terminate accounts without prior notice if these Terms of Use are violated or if we decide, in our sole discretion, that it would be in the Company’s best interests to do so. You are solely responsible for all content that you upload, post, email, or otherwise transmit via the Site. You acknowledge and agree that we may monitor or review your content and reserve the right to remove, delete, edit, limit, block, or prevent access to any of your content at our sole discretion. Additionally, you understand and agree that we are under no obligation to display or review your content.
The Company accepts payments through Credit Cards, Debit Cards, and Net Banking or cash.
The company reserves all intellectual property rights, including but not limited to registered or unregistered marks of the Company, text, graphics, logos, digital downloads, data compilations, software, and other materials on this App. Mere use or access of the Site does not give any User the right to use any intellectual property of the Company. AroundMe does not represent or warrant that (a) our services will be uninterrupted, secure, or error-free, (b) any defects or errors in our services will be discovered or corrected, or (c) that any content or information you obtain on or through our services will be accurate, complete, current, or appropriate for your purposes. Furthermore, AroundMe makes no guarantees as to the number of active users at any time; users' ability or desire to communicate with or meet you, or the ultimate compatibility with or conduct by users you meet through the services.
AroundMe assumes no responsibility for any content that you or another User or third party posts, sends, receives, or acts on through our services, nor does AroundMe assume any responsibility for the identity, intentions, legitimacy, or veracity of any Users with whom you may communicate through AroundMe. Any material downloaded or otherwise obtained through the use of our services is accessed at your own discretion and risk. AroundMe is not responsible for any damage to your computer hardware, computer software, or other equipment or technology including, but without limitation, damage from any security breach or from any virus, bugs, tampering, hacking, fraud, error, omission, interruption, defect, delay in operation or transmission, computer line or network failure, or any other technical or other disruption or malfunction.
We shall not be held liable in any way. In no event shall we or our affiliates, employees, agents, content providers, or licensors be liable for any indirect, consequential, special, incidental, or punitive damages including, without limitation, damages related to unauthorized access to or alteration of your transmissions or data, the content or any errors or omissions in the content, even if advised of the possibility of such damages.
You may be introduced to, or be able to access, information, websites, advertisements, features, contests, or sweepstakes offered by other parties. We are not responsible for the actions or policies of such third parties. The Company reserves the right to terminate the Terms of Use at any time without notice and bears no liability for the same. By discontinuing the use of the App and deleting their account, the User can terminate the Terms of Use anytime. Upon termination, the Company destroys the information collected, including any Copies within 30 days and retains only non-identifiable data for the purposes of research and algorithm training.
The User also agrees to defend, indemnify, and hold the Company or its employees, directors, officers, agents, successors, and any other related concerns, from any and all claims, liabilities, damages, losses, costs, and expenses, including attorney's fees. These claims may arise from your actions or inactions, leading to any loss or liability to the Company, including but not limited to breach of any warranties, representations, or undertakings, non-fulfillment of obligations under the Terms of Use, or violations of applicable laws and regulations, such as Intellectual Property Rights, payment of statutory dues and taxes, claims of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers, and infringement of intellectual property or other rights. Importantly, this obligation remains in effect even after the expiry or termination of the Terms of Use.
The Terms of Use and Policies are governed by the applicable laws of India, with exclusive jurisdiction given to the Courts at Hyderabad for related proceedings.
Any disputes, including those regarding interpretation or application, shall be resolved through arbitration by an independent arbitrator whose decision is final and binding. This arbitration follows the Arbitration and Conciliation Act, 1996, with the seat and venue in Hyderabad. The Company reserves the right to seek injunctive, provisional, or interim relief from any court to safeguard its intellectual property or confidential information pending arbitration.
In cases of disputes concerning orders outside India, the international arbitration rules of the Indian Arbitration and Conciliation Act, 1996, apply, with the seat and venue of international arbitration also in Hyderabad.
